Goods damaged during shipment may be replaced if Salsas La Llorona is notified within ten (10) days of delivery confirmation. h) Product Descriptions. Salsas La Llorona attempts to be as accurate as possible. If a product offered by Salsas La Llorona is not as described, your sole remedy is to return it.

i) Jurisdiction and Venue. You agree that any legal action brought against Salsas La Llorona shall be governed by the laws of the State of California without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Salsas La Llorona sites shall be an appropriate federal or state court located in Fresno County, California.

j) Sales Taxes. Salsas La Llorona shall automatically charge and withhold the applicable sales tax for orders shipped to New York, California, Tennessee, Delaware, and Utah.

k) Shipping. Most orders will be shipped via FedEx ground. Once an order is shipped, it is the customers responsibility to make themselves available to receive the shipment. Once the delivery service has attempted to deliver the package without success, they will return the package to a Salsas La Llorona distribution center. At this point, Salsas La Llorona will credit the customer's account for the undeliverable order (except for shipping and handling charges) and it will be the customer's responsibility to place a new order. Please allow 10 business days for a credit to process. See the FAQs section for questions regarding returned shipments and consumer credits.

l) Risk of Loss. All items purchased from Salsas La Llorona are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

m) Returns and Exchanges. Please read the policies below to gain a better understanding of how Salsas La Llorona can process a return or exchange as quickly as possible. Salsas La Llorona will replace any damaged product if notified within ten (10) days of the delivery confirmation date. Customer is responsible for shipping and handling expenses.

*Returned merchandise must include all original packaging in the same saleable condition in which it was received. Refunds for returns will cover product amount and any sales taxes charged. Refunds will not be made for any shipping and handling charges. Returns not meeting these requirements may be subject to a restocking fee equaling 15% of the price paid for Salsas La Llorona products. (not including taxes). Damaged merchandise, cosmetically or otherwise, is subject to a restocking fee on a case-by-case basis. If an order has shipped, it is the purchaser's responsibility to accept the shipment and return the order per our Return Policy. Orders that are refused at the designated shipping address may incur a 15% restocking fee.
Salsas La Llorona will not accept any returns outside of the 10 day window. Items that are returned more than 10 days after delivery, not in saleable condition, or are missing packaging, will not be accepted for return or exchange.

n) Typographical Errors. In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Salsas La Llorona shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Salsas La Llorona shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Salsas La Llorona shall immediately issue a credit to your credit card account in the amount of the charge.

o) Privacy. Your Privacy is very important to us. The products you order from Salsas La Llorona will require us to collect billing and shipping information (such as your name, address, email address, phone number, and credit/debit card information). We will use the personal information you provide only to process that order. We do not share this information with outside parties except to the extent necessary to complete that order. Salsas La Llorona does collect the e-mail address of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, user specific information on what pages consumers access or visit and information volunteered by the consumer, such as survey information and/or site registrations.

The information we collect is used for internal review and is then discarded, used to improve the content of our Web page, used to customize the content and/or layout of our page for individual consumer and used by us to contact consumers for marketing purposes.
